Perhaps their miscalculation was understandable because the center of Solomon Amendment controversy was Congress’s effort to control what it believed was an intolerable level of sass and disrespect from law schools toward the military. When the stated purpose of a law is to “send a message” or to force a display of respect toward government institutions, then generally a nugget of a First Amendment claim lies somewhere within.

FAIR, but they did, and spectacularly. The vote was 8–0, and it would have been 9–0 had Justice Sandra Day O’Connor not retired before the decision was handed down. The conservatives of the Court voted in the government’s favor; the liberals voted in the government’s favor. ) The unanimous vote was not even the worst insult. The opinion condescendingly lectured the law schools on all the simple points of constitutional law the Court thought they failed to understand. The Court cracked jokes at their expense; it laughed as much as courts can laugh while writing a formal judicial opinion.

The process of finding legal jobs in government service, or of finding qualified applicants for those positions, happens mostly outside the typical law school recruiting apparatus. I’ve never heard district attorneys, public defenders, or lawyers for the federal government complain they can’t hire quality law students without participating in sponsored interviewing programs. They often opt out because they don’t believe it serves their different needs. Perhaps they want to set themselves apart from the pack that law students tend to mindlessly chase.
