But nonetheless, it was a vehicle that allowed us to start talking about the injustices, inequalities, and inequities that gay folks suffer from in the work environment, and in a fashion that was hard for opponents to resist. After the Vermont struggle precipitated by Baker, interest groups opposing same-sex marriage suspected that it was only a matter of time before the issue arose through litigation in other states.

He was fully anticipating that they would not make the decision they did. We knew that it would be a divided court. Going in, based on the way the justices asked questions during the oral argument, we thought, leaving there, that there were two, Chief Justice 42 goodridge [Margaret] Marshall and Justice [John] Greaney, who were solidly going to vote to create so-called homosexual marriage. ’’ So that left three, and we didn’t know how they would come out. So we were confident it was going to be a split decision, but we just didn’t know how it was going to turn out.

In my mind, we were basically looking at civil unions. We were starting to have those discussions, but it was always with a caveat, as far as the opposition was concerned, with 40 goodridge regard to the definition of marriage. That was the key step that always got in the way of coming to final agreement. I think that we had really hit a stalemate before the Goodridge decision arrived. We knew that the potential was out there and basically had decided that we couldn’t compromise with a DOMA, with the definition of marriage.
